MINUTES OF REGULAR MEETING
MADDOCK CITY COUNCIL
February 7, 2005
A regular meeting of the Maddock City Council was held on February 7, 2005 at 5:30 p.m. at the council chambers. Members present to answer roll call were Mayor Kevin Winson, Marilyn Allan, Wayne Knatterud, Mark Finley and Rodney Maddock.
Renee Beeter, representative of Waste Management, was present to discuss the termination notice the city had with Waste Management. She informed the group the contract read “Notice must be given at least 60 days prior to the renewal date.” Maddock’s notice was not given within the 60-day requirement and therefore the contract automatically renewed for three years. Waste Management offered to drop fuel charges for three years and provide individual carts for each home at no cost, and continue to keep its service level where it is or improve it if a problem exists. Renee excused herself and the meeting began.
Minutes of the January meeting were read. Rodney Maddock moved the minutes be approved. Mark Finley seconded the motion. Motion carried.
Bills were audited. Two for the multi-purpose building were also ordered paid. Mark Finley moved to approve the bills. Rodney Maddock seconded the motion. Motion carried. Bills approved were as follows:

Frank Mosser reported he has the 1983 Chevrolet highway truck in for repairs. He presented an estimate to update the Christmas decorations for the light poles. It will cost approximately $700.00 to replace the trim and lights. Marilyn Allan moved to approve repair costs. Rodney Maddock seconded the motion. Motion carried.
Water operator Keith Winson reported the letter on the failed water test is out and posted on Channel 7. He is working on a new treatment to counteract the problem at hand. Corrective action is under the supervision of the State Health Dept.
Mayor Winson returned to the item of garbage service. There was a motion made back in January to change service. Wayne Knatterud reconsidered the motion he made on January 3, 2005 on changing service company. Rodney Maddock seconded the reconsideration. Show of hands was taken with five in favor and none against. Motion was removed.
Kevin Winson reminded the group of the EDA meeting tonight. The annual dinner and expo are set for February 27.
The multi-purpose building was the next item of concern. It was asked if the committee needs an engineer and/or an architect for this project.
Auditor Mosser is to get in writing an opinion from the city attorney on this matter.
Auditor Mosser presented a photo of a mobile home in which the owner is requesting to purchase lots to place the home. After a discussion on the matter the auditor is to offer a portion of Lot 3, Sub Division 2 for sale in the amount of unpaid special assessments. A letter will be sent to the interested party. Mark Finley moved to approve the offer. Rodney Maddock seconded the motion. Motion carried.
A request was made by Marilyn Allan to use the gray shed for plants by the library. The sale would be open only three days a week as a fund raiser for the library.
Other items discussed were snow removal at the Maddock Business & Technology Center and gaming by the EDC.
The next meeting date will be March 7, 2005 at 5:30 p.m.

Rodney Maddock was absent.
Minutes of the February meeting were read. Wayne Knatterud moved the minutes by approved. Mark Finley seconded the motion. Motion carried.

Water operator Keith Winson informed the council of a new treatment being used at the water plant. He presented a Smart2-Color meter for testing water and asked about purchasing a unit for the city. Wayne Knatterud moved to purchase a unit. Marilyn Allan seconded the motion. Motion carried.
Auditor Mosser presented a question on a past due account. A letter is to go out with a termination date and a plan to pay past due accounts.
Two members of the Kids on the Block board were present and gave a balance sheet on the finances of the facility to date. They are not making the cash flow and are asking for ideas and suggestions. It was determined there will be a public meeting in April and if no sure answers are found, the closing date is set for June 30, 2005.
One building permit was presented for Ruth Wallin to re-side her residence.
Wayne Knatterud moved to approve the permit. Mark Finley seconded the motion. Motion carried.
One gaming permit was presented for the Sons of Norway to hold a raffle.
Marilyn Allan moved to approve the permit. Wayne Knatterud seconded the motion. Motion carried.
The contract for Waste Management to service the city of Maddock for sanitation service was presented. It set its disposal of waste fee at $3,650.00 per month with no surcharges or fuel fees to be added for the next three years. Mayor Winson will sign the contract and it will be returned.
The next regular meeting will be April 4, 2005 at 6:30 p.m.

PUBLIC NOTICE
Workforce Safety and Insurance (WSI) will accept proposals for litigation services to represent WSI in administrative hearings, District Court appeals, and Supreme Court appeals. One or more law firms/attorneys will be selected to provide litigation service for WSI.

NOTICE OF PETITION
TO CLOSE ROADWAY
The Benson County Board of Commissioners will formally hear a petition, which has been filed to close a roadway in Isabel Township, Benson County, North Dakota, more properly described as; The congressional section line making up the south boundary of Section Twelve (12) and the north boundary of Section Thirteen (13), Township One Hundred Fifty-three (153) North, Range Seventy (70) West (Isabel Township), Benson County, North Dakota.
The request to close the roadway is made pursuant to NDCC 24-07-05. The hearing on the Petition will take place on April 8, 2005 at 11:00 o’clock a.m. at the scheduled meeting of the Benson County Board of Commissioners.
The Petition is on file at the Benson County Auditor’s Office for all persons wishing to see the petition in advance of the meeting, and can be accessed between the hours of 8:30 and 4:30 Monday through Friday, or by calling 701-473-5340.
