The Benson County Commissioners met in regular session on Tuesday, November 15, 2005 at 9 a.m. Commissioners present were Jason Lee, Curtis Hvinden, Ed Ripplinger and Dwain Brown. Barry Cox was absent. The meeting was called to order by Chairman Lee.
A motion was made by Hvinden, seconded by Brown, to approve the minutes of the regular meeting on November 2, 2005. All members voted yes. The motion carried unanimously.
Brad Darr and Grant Levi, NDDOT, met with the board regarding the state abandoning the old portion of U.S. Hwy. #281 when the new portion is trafficable. Levi informed the board the state is willing to work with the county in keeping portions of the roadway open if necessary. Darr stated the concrete barriers will be removed when the road is abandoned north of Minnewaukan and the old roadway will be eroded away. Commissioner Ripplinger stated the county cannot afford to maintain the old roadway.
James P. Wang, Benson County State's Attorney, commented that the county would have liability issues if it assumed responsibility for the old roadway. The board suggested a meeting be set up with the board of supervisors of the affected townships and the city of Minnewaukan to get their input on this issue. The board will then nominate one representative from each entity to serve on a committee to determine what portions of the old roadway are necessary for access. The board concluded it will meet with representatives of the affected townships and the city of Minnewaukan at its next meeting on December 6, 2005.
Commissioner Ripplinger questioned the county auditor as to why the $90,000.00 has not been paid to the city of Maddock for the multi-purpose building. The auditor stated there has not been any written signed agreement or any other documents presented to the board in return for the $90,000.00. Ripplinger stated the money is to be paid out regardless if there is a written agreement or not as there is currently a gentleman's agreement in place. State's Attorney Wang stated the paperwork is in progress and a written agreement must be in place prior to the money being issued.
At 10:00 a.m. the annual tax sale was held. People present for the sale were Fred and Gloria Vetsch and Lowell Baustad.
Lowell Baustad submitted the high bid of $325.00 for Block 9 in Fillmore, Benson County, ND. A motion was made by Hvinden, seconded by Brown, to have the chairman sign a county deed transferring the property to Lowell Baustad. All members voted yes. The motion carried unanimously.
Kelly Wang submitted the high bid of $217.28 on the property described as Lots 13 & 14, Block 18, Original, Warwick City. A motion was made by Hvinden, seconded by Brown, to have the chairman sign a county deed to Kelly Wang. All members voted yes. The motion carried unanimously.
No bid was received for Lots 7 & 8, Diamond Beach Subdivision in Sec. 13, Twp. 152, Rge. 63.
The board reviewed a letter dated November 10, 2005, written to the Department of Insurance, State Bonding Fund, by State's Attorney Wang regarding Bond Claim #71 filed by the Benson County Housing Authority.
The board also reviewed a letter from Dwayne J. Oster, NDRIN, dated November 8, 2005, regarding grant monies available to counties.
Information from the October 12, 2005 meeting of the Devils Lake Basin Joint Water Resource District Board was presented to the board.
The board reviewed the proposed "Call for Bids" for the purchase of three new motor graders.
The board also reviewed a memo from the county auditor dated November 14, 2005, regarding budget issues.
A motion was made by Ripplinger, seconded by Brown, to rescind the motion made at the November 2, 2005 meeting which transferred $3,500.00 from the General Fund to the Emergency Administration Fund. All members voted yes.
The motion carried unanimously.
A motion carried unanimously to adjourn the meeting.

CALL FOR BIDS
One or More Motor Graders
Bid opening: December 20, 2005, 11:00 a.m. CDT, Benson County Courthouse, County Commissioners Rm.
One or more Motor Graders to be new 2006 model, including all new parts and accessories, and meet all minimum detail specifications. Motor Graders are to include new fully hydraulic wings, with trade of old wings. All bidders shall bid on Minimum Detail Specification Form supplied by Benson County.
Bid is for 4 wheel drive machine and/or 4 wheel drive with front wheel assist. Bidders specifications must be completed.
All bidders shall supply with their bid a copy of the standard warranty offered, plus an extended total machine warranty to 5 years/7500 hours whichever occurs first.
All bids shall be accompanied by a separate envelope containing a Bidder's Bond or Certified Check in the amount of five percent (5%) of the base price, payable to Benson County as liquidated damages in accordance with Section 11-11-28, NDCC. Such deposit shall be to insure prompt delivery and conformity to the specifications.
Bids shall be submitted in a sealed envelope to Benson County Auditor's Office, PO Box 206, Minnewaukan, North Dakota, which identified the bidder and the Motor Grader Bid contained therein.
All bidders must show if item bid is standard or optional. If optional, bid must show what the price of the option is as bid to Benson County. If option not available, it must be noted as such.
Bidders shall bid on the proposal form supplied by Benson County and shall bid lease price and total cost price. Benson County may hold the bids for up to forty-five (45) days. Proposal forms are available at the Benson County Auditor's Office, or Benson County Hwy. Department, Minnewaukan, North Dakota.
To protect Benson County and to develop a guaranteed depreciation schedule on the machine purchased, Benson County has the option to return the machine purchased to the successful bidder as per the following time periods or hours (whichever is first) after the delivery date. The successful bidder guarantees repurchase of the machine based on the following schedule in cash to Benson County.
Benson County reserves the right to evaluate the bids according to these specifications and make awards according to the discretion of its Board of Commissioners. Benson County also reserves the right to reject any or all bids and to waive any irregularities.

November 8, 2005
A regular meeting of the Warwick City Council was held November 8, 2005.
The meeting was called to order by Mayor Darrell Forest. Members present were George Evans, Shirley Tiokasin and Leslie Elfman.

December 5, 2005
A regular meeting of the Warwick City Council was held December 5, 2005.

The North Dakota Department of Transportation (NDDOT) will receive bids for the construction of the following project:

Location: Various Locations Around Devils Lake Bids will be received until 1:00 p.m., January 6, 2006, at the front desk of the Devils Lake District office. Bids will be opened at that time.
All bidders are required to be prequalified at least seven (7) days before the date of the bid opening.
The proposal forms, plans, and specifications are available for bidding until 10:00 a.m. the day preceding the bid opening, and may be inspected at the Devils Lake District office, 316 6th Street SE, Devils Lake, ND 58301.
NDDOT reserves the right to reject any and all proposals, waive technicalities, or to accept such as may be determined in the best interests of the state.
